1. Introduction

Welcome to BulkSMS.ca, India’s most trusted bulk messaging provider offering DLT-approved, high-speed, and secure messaging solutions for businesses. By using our services, you agree to comply with our Terms & Conditions, Privacy Policy, and TRAI/DLT regulations.

2. Registration & Account Usage

2.1 User Eligibility

  • You must be at least 18 years old to register.
  • Only businesses, organizations, or legal entities can use our bulk SMS, WhatsApp, and voice services.

2.2 Account Responsibility

  • Users are responsible for maintaining the confidentiality of their login credentials.
  • Unauthorized use of an account must be reported immediately to [email protected].

2.3 Registration Process

  • All users must complete the DLT registration as per TRAI regulations.
  • Failure to complete DLT registration will result in restricted access to our bulk SMS API and portal.

3. Acceptable Use Policy (AUP)

To ensure compliance with TRAI guidelines, users must adhere to the following:

3.1 Prohibited Content

  • Spam, phishing, or fraudulent messages.
  • Unsolicited promotions sent to DND (Do Not Disturb) numbers without prior consent.
  • Content that violates Indian laws, including hate speech, violence, or misleading advertising.

3.2 Messaging & API Restrictions

  • Users must register all Sender IDs & SMS templates in accordance with DLT regulations.
  • Messages must comply with TRAI’s commercial communication rules.
  • Bulk promotional messages can only be sent between 10 AM to 9 PM.
  • Transactional messages (OTP, alerts, and banking notifications) are allowed 24x7.

4. Payment, Refunds & Credits

4.1 Payment Terms

  • Payments must be made 100% in advance before using any services.
  • Accepted payment methods: Net banking, UPI, Credit/Debit cards.

4.2 Credit Expiry & Refunds

  • SMS credits expire after 12 months of inactivity.
  • Refunds are not applicable for used credits.
  • If undelivered messages exceed the threshold, refunds will be processed automatically.

5. Compliance with TRAI/DLT Regulations

5.1 DLT Registration Requirement

  • All businesses must register on a DLT platform (Jio, Airtel, Vodafone, BSNL) to send bulk SMS.
  • Unregistered users will have limited or denied access to messaging services.

5.2 Legal & Regulatory Compliance

  • Users must ensure their campaigns comply with TRAI’s SMS regulations.
  • Non-compliance may result in legal penalties and account suspension.

6. Account Suspension & Termination

6.1 Grounds for Account Suspension BulkSMS.ca reserves the right to suspend or terminate accounts for:

  • Sending spam or unauthorized marketing messages.
  • Failing to complete DLT registration.
  • Repeatedly violating TRAI/DLT policies.
  • Misusing the bulk SMS API for fraudulent activities.

6.2 Reinstating a Suspended Account

  • Users may appeal a suspension by contacting   [email protected].
  • Reinstatement will be subject to TRAI and BulkSMS.ca review policies.

7. Limitation of Liability

  • BulkSMS.ca is not responsible for message delays due to telecom operator failures.
  • We do not guarantee 100% delivery for all SMS due to factors beyond our control.
  • Users agree to indemnify BulkSMS.ca against legal claims resulting from message content violations.

8. Privacy & Data Security

  • All user data is protected under our Privacy Policy.
  • We follow 128-bit encryption standards for securing customer data.
  • User data is never shared with third-party advertisers.

9. Amendments to Terms & Conditions

  • BulkSMS.ca reserves the right to modify these terms at any time.
  • Changes will be communicated via email or website notifications.
  • Continued use of services after changes implies acceptance.

10. Governing Law & Jurisdiction

  • These Terms & Conditions are governed by Indian law.
  • Disputes will be resolved in Zirakpur, Punjab (Near Chandigarh) courts.
